Federal Judge That Is To Decide Constitutionality Of Prop 8 And Traditional Marriage Is Himself Gay

NBC Bay Area reports that it turns "out 9th District Court of Appeals Judge Vaughn Walker, who is currently considering testimony in the closely watched marriage-rights case regarding the constitutionality of California's Proposition 8, is himself gay... Asked if he had any problem with the issue of his sexuality being raised so publicly, Walker responded 'No comment.'"

    What if he was heterosexual? Would that be a problem too?

    It is not necessarily a problem. But if the judge rules that Prop 8 violates the Equal Protection Clause of the United States Constitution it may create questions as to whether personal interests were what was actually playing a role.
